Below you will find our cancellation policy, both for the purchase of physical goods (e.g., USB sticks) and for digital products.

A. Cancellation policy

Introduction

Consumers are entitled to a right of withdrawal in accordance with the following provisions, whereby consumers are any natural persons who enter into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity:

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

You can use the attached sample withdrawal form for this purpose, but this is not mandatory.

You can also fill out and submit the sample withdrawal form or another clear statement electronically on our website https://softwareindustrie24.de/widerrufsbelehrung-widerrufsformular. If you use this option, we will immediately (e.g., by email) send you confirmation of receipt of such a withdrawal.

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period expires.

Important: For a contract for the provision of digital content that obliges you to pay a price, the following applies: The right of withdrawal also expires (prematurely) if you have expressly agreed that we may begin fulfilling the contract before the withdrawal period expires, you have confirmed your knowledge that your right of withdrawal expires upon commencement of contract fulfillment, and we have provided you with confirmation of this. The right of withdrawal also expires if a product key or key has been used to register or activate software. It is important to note that the activation or registration of software with the product key cannot be reversed, which means that the right of withdrawal no longer applies in this case.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

You shall bear the direct costs of returning the goods.

You shall only be liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing their condition, properties, and functionality.

Exclusion or premature expiry of the right of withdrawal

For a contract for the provision of digital content that is not on a physical data carrier and which obliges you to pay a price, the following applies: The right of withdrawal also expires (prematurely) if you have expressly agreed that we may begin fulfilling the contract before the withdrawal period expires, you have confirmed that you are aware that your right of withdrawal expires upon commencement of the contract, and we have provided you with confirmation of this. The right of withdrawal also expires if a product key or key has been used to register or activate software. It is important to note that the activation or registration of software with the product key cannot be reversed, which means that the right of withdrawal no longer applies in this case. In accordance with Section 356 (5) of the German Civil Code (BGB), the right of withdrawal expires for digital content as soon as the execution of the contract has begun, in this case through the activation of the software. Subsequent withdrawal is therefore legally excluded once activation has taken place.
